Frequently Asked Questions about Debt in Missouri
There are two types of debt that you can legally be arrested for not paying: taxes and child support. While it’s not common to go to jail for debts such as credit card debt, student loans, payday loans, utility bills and medical bills, some debt collectors use the court system to put debtors in jail if they don't pay their debts.
To be on the safe side: if you receive a notice or order from the court, take it seriously and do not ignore it.
In Missouri, a judgment is considered “active” (collectible) for ten years.
If a creditor is successful in suing you and secures a judgment against you for not paying a debt, Missouri generally follows federal limits on wage garnishments. However, if your tax status is Head of Household, Missouri law protects more of your income.
Under these limits, for any workweek, a creditor can garnish the lesser of 25% of your disposable earnings (10% of your disposable earnings if your tax status is Head of Household), OR the amount by which your weekly disposable earnings (wages left after your employer has made deductions required by law) exceed 30 times the federal hourly minimum wage.
- 75% of your disposable earnings (90% if your tax status is Head of Household)
- Personal belongings up to $3,000 in value
- Vehicles up to $3,000 in value
- Up to $15,000 of the value of a home ($5,000 for a mobile home)
Is Missouri Debt Settlement Right for Me?
Choosing the right debt relief program depends on the amount and type of debt owed, among other factors. Missouri debt settlement may be the best option for getting out of debt if you:
Have a significant amount of credit card debt
Can’t afford your monthly credit card payments
Have medical bills you can’t afford to pay
Have payday loans
Debt related to utility bills, cell phone bills, apartment leases, personal loans and private student loans may also be eligible for settlement. Note that debt on federal student loans is typically very difficult to reach a settlement on.
